Summary of Key Terms
GrocerIQ provides independent grocery price intelligence and budgeting tools. We do not sell groceries directly and are not affiliated with the supermarkets listed. Supermarket register prices always override app estimates. By using GrocerIQ, you agree to these terms, including our acceptable use policy, warranty disclaimers, and dispute resolution process.
1. Agreement to Terms & Eligibility
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and GrocerIQ (“GrocerIQ”, “we”, “us”, or “our”), governing your access to and use of our mobile applications, websites, offline databases, and AI features.
By downloading, installing, creating an account, accessing, or using the GrocerIQ mobile application or services, you expressly acknowledge and agree to be bound by these Terms and our Global Privacy Policy. If you do not agree to these Terms, you must not download, install, or use the application, and must immediately uninstall and discontinue all use.
- Age Requirement:You must be at least 18 years old (or the legal age of majority in your jurisdiction) to enter into these Terms.
2. Independent Service & Supermarket Price Disclaimers
GrocerIQ is an independent price intelligence platform. We are NOT affiliated with, sponsored by, authorized by, or endorsed by any retail supermarket chain, grocery store, or warehouse club mentioned on our platform. All store names and trademarks remain the exclusive property of their respective owners.
- Estimates for Comparison Only:All grocery prices, historical charts, basket calculations, and swap savings are estimates compiled from public benchmarks, crowd-sourced reports, and user receipt scans.
- Cashier Price Overrides App Data:Supermarket retail prices, discounts, and inventory fluctuate continuously. The physical shelf price tag and checkout register total at the physical store cashier is always the official final price and will override any information displayed in GrocerIQ.
- No Stock or Price Guarantees:GrocerIQ does not guarantee the availability, exact price, or inventory status of any item at any retail store location.
3. Generative AI Disclaimers (“Ask Suki AI” & “Chef Suki”)
GrocerIQ provides automated generative artificial intelligence tools to assist with meal planning, budget tips, and ingredient substitutions.
- No Medical or Dietary Guarantee:AI-generated recipes, nutrition estimates, and ingredient swaps are for culinary convenience only. Suki is not a certified nutritionist, dietitian, or healthcare professional.
- Allergen & Safety Responsibility:You are solely responsible for checking product packaging labels, food allergens, expiration dates, and preparation safety before preparing or consuming food.
- Automated Output Variability:Generative AI may occasionally produce inaccuracies or unexpected suggestions. GrocerIQ disclaims liability for recipe outcomes or dietary consequences.
4. Acceptable Use & Prohibited Conduct
You agree to use GrocerIQ solely for lawful personal or household grocery planning. You strictly agree not to:
- Scrape, crawl, harvest, or bulk-export data from our barcode catalogue or price index using automated bots or scripts.
- Decompile, reverse-engineer, or attempt to derive the source code or local database architecture of the GrocerIQ application.
- Upload forged, fraudulent, malicious, or non-grocery receipts to the OCR scanner.
- Resell, package, or commercially exploit GrocerIQ's proprietary price databases without prior written authorization.
- Interfere with or disrupt the integrity, security, or performance of our servers and service infrastructure.
5. Subscriptions, Payments & In-App Purchases
GrocerIQ offers free core features as well as optional paid subscriptions (“GrocerIQ Pro”) billed on a recurring monthly or annual basis.
- Secure Payment Processing:All subscription payments and renewals are processed securely through the official Google Play Store billing platform. GrocerIQ never collects, accesses, or stores your credit/debit card numbers, bank details, or e-wallet credentials.
- Supported Payment Methods:You can pay using your Google Play linked payment methods, including GCash, Maya, ShopeePay, credit/debit cards (Visa, Mastercard), or mobile carrier billing (Globe, Smart), protected by your device's biometric authentication or Google account PIN.
- Recurring Billing:Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to the renewal date via your Google Play Store subscription manager or the Manage Subscription link in your GrocerIQ account settings.
- Currency & Taxes:Subscription fees are billed in the currency displayed at checkout, inclusive of applicable sales taxes or VAT where required by law.
- Cancellations & Strict No-Refund Policy:All subscription purchases, renewals, and payments are strictly final and non-refundable. You may cancel your subscription at any time via the Google Play Store to prevent upcoming renewal charges. We do not issue refunds, prorated cash credits, or partial-cycle reimbursements for early cancellations, unused features, or remaining AI query balances.
6. Mobile App Marketplace Terms (Google Play)
When you download GrocerIQ from the Google Play Store, you acknowledge and agree that these Terms are concluded between you and GrocerIQ only, not with Google LLC.
Google is not responsible for the application, its content, maintenance, support, or warranty claims. Google and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
7. Intellectual Property Rights
The GrocerIQ brand, logos, user interface, software, algorithms, and database structures are the exclusive intellectual property of GrocerIQ, protected by international copyright and trademark laws.
- User Data License:By submitting price updates or uploading receipt images, you grant GrocerIQ a worldwide, perpetual, royalty-free license to extract, process, aggregate, and publish the underlying product price data in anonymized form.
8. Disclaimer of Warranties (“AS IS”)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE GROCERIQ SERVICE, OFFLINE BARCODE INDEX, PRICE COMPARISONS, AND AI OUTPUTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, FULLY ERROR-FREE, OR FREE OF DEFECTS.
9. Limitation of Liability & Damages Cap
UNDER NO CIRCUMSTANCES SHALL GROCERIQ, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, RELIANCE ON PRICE ESTIMATES, OR TEMPORARY SERVICE OUTAGES.
GROCERIQ'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO GROCERIQ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $25.00 (OR LOCAL CURRENCY EQUIVALENT), WHICHEVER IS GREATER.
10. Dispute Resolution & Class Action Waiver
Please read this section carefully, as it impacts your legal rights regarding dispute resolution:
- Informal Resolution First:Before filing any formal legal action, you and GrocerIQ agree to attempt in good faith to resolve any dispute informally for at least thirty (30) days by contacting groceriq@gmail.com.
- Class Action Waiver:To the fullest extent permitted by law, all claims and disputes must be brought on an individual basis, and you agree not to initiate or participate in any class action, collective lawsuit, or representative proceeding against GrocerIQ.
- Consumer Protection Carve-out:Nothing in these Terms shall limit or exclude your statutory consumer rights under non-waivable mandatory consumer protection laws of your country of residence.
11. Modifications & Contact Information
We reserve the right to modify these Terms from time to time. If material changes are made, we will notify users through in-app notices or website announcements. Continued use of the application signifies acceptance of updated terms.
